1. Motion to adopt an amended Senate Constitution and for other purposes. (Mr. Andrews, Ms. Buffard-O'Shea)
MOVED, that the Senate propose to the Faculty, the President and the Board the adoption of the attached amended Senate Constitution and further
MOVED, that subsequent to the approval of the amended Senate Constitution by the Faculty and the Board, the Senate cooperate with the AP Assembly, the Student Congress and the Provost in the establishment of a University Council that would include the Provost, the Senate President, the AP Assembly President, and the Student Congress President. The University Council would ensure that all governance bodies are appropriately consulted.
Second reading: Debatable, amendable, and eligible for final vote at this meeting.
1a. Amendment from the Steering Committee to make technical corrections and to provide transition rules with respect to the pending motion. (Mr. Andrews)
MOVED, that the pending draft of an amended Senate Constitution be modified
as follows:
1. In Article IV, paragraph i, first sentence, change "The University Senate" to "the University Senate"
2. In Article IV, paragraph xii, last sentence, change "debate ," to "debate,"
3. In Article VI, paragraph ii, change "be a full-time, non-visiting faculty member of any rank" to "be full-time, non-visiting faculty members of any rank"
4. In Article VI, change the first occurrence of the title "the Vice-Provost and Dean of Graduate Study" to "a Vice-Provost". Change the remaining occurrences of this title to "the Vice-Provost".
5. In the concluding Editor's note, change "June 1, 1977" to "June 2, 1977" and "February 14, 1984" to "February 15, 1984"; and be it further
MOVED, that should the proposed amendments be approved by the Faculty and the Board, the transition from the current Senate structure to the new Senate structure be governed by the following rules:
1. The Provost, ex-officio, will continue to act as head of the Senate and chair of the Senate Steering Committee until the election of the Senate President at the first meeting of the newly constituted Senate.
2. The current Steering Committee will continue to perform all of its duties until Steering Committee elections take place in September 1999.
3. If a unit chooses to conduct its 1999-2001 Senate elections prior to the effective date of the amended constitution, then the election shall be conducted using the current eligibility and apportionment procedures. The results of that election shall be used to fill seats in the newly constituted Senate in a manner that reflects the new eligibility and apportionment procedures. Should the results of the election be insufficient to fill all allocated seats, then the unit's usual procedures for filling vacancies shall be used to fill any such vacancies.
4. If a unit chooses to conduct its 1999-2001 Senate elections after the effective date of the amended constitution, then the election shall be governed by the new eligibility and apportionment procedures.
Comment: Copies of the Constitution with the proposed revisions can be found at here. New language in the attached amended Constitution is in italics; deleted language is struck through. The amendments address the composition and election of the Senate. They provide for a Senate consisting of fifty elected faculty senators, one AP senator, one student senator and the Provost. They also provide for an elected faculty presiding officer and remove some obsolete or sexist language. The current Senate structure provides for forty-three elected faculty senators and eighteen ex-officio or non-faculty senators. Neither of the other two constitutional governance bodies on campus, the AP Assembly and the Student Congress, contains such a high number of voting members who are ex-officio or not part of their ownership groups. Both of these bodies also have elected heads. Both of these factors have a significant impact on the ability of the Senate to represent the views of its ownership group, which is the faculty. Although academic administrators are members of the organized faculties, these individuals are both represented in the Senate by the Provost and have avenues and opportunities for consultation not available to other members of the three constitutional governance bodies.

The names listed above, drawn principally from volunteer lists, reflect the Steering Committee's current expectations about committee membership. Veteran senators will not be surprised to find corollary motions on subsequent agendas to replace members who will be on leave. Faculty who wish to volunteer for Senate standing committees may still make their wishes known to the Steering Committee and will be considered as vacancies arise. When considering the overall balance of these committees, it is important to remember that most have student and administrative members as well as faculty elected by the Senate.
